Please Review the Following Terms and Conditions

In these terms and conditions, "we", "us", "Skeleton", or "Skeleton Glass" means Skeleton Glass ABN: 80 707 327 068 and "you", "the client" means the person, organisation or entity that purchased the products or related services from us.

These terms and conditions govern the relationship between you and Skeleton Glass. You agree that by placing an order with Skeleton Glass, you are bound by these terms and conditions in relation to the supply of that order by Skeleton Glass to you. To the extent that these terms and conditions apply to an existing order, they may on be varied by written agreement between you and Skeleton Glass.

Accessing Our Website

We will not be liable if, for any reason, our website is unavailable at any time or for any period. From time to time, we may need to restrict access to our website (wholly or partly).

You are responsible for making all arrangements necessary for your own access to our website. You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these terms and conditions and that they comply with them.

Information On This Site

Our website and the content on our website are subject to copyright, trademarks and other intellectual property rights. These rights are owned by or licensed to Skeleton Glass.

You must not reproduce, transmit, communicate, adapt, distribute, sell, modify, publish, or otherwise use any material on our website, including audio and video excerpts, except as permitted by statute or with our prior written consent.

Our Product

We endeavour to ensure that all the products on our website are accurately described, and we rely on information provided to us by our suppliers. Unfortunately, on some occasions, it is possible that our website will contain errors, and we reserve the right to correct any errors or inaccuracies at any time, including after you have placed an order.

In some cases, the products we offer for sale are made from natural or handmade materials, and as a result, there may be small variations between the product image(s) and the product you receive. We endeavour to ensure that all finishes are displayed accurately, but you should be aware that finishes and colours may appear different from the true finish and colour on different displays and screens. Due to the nature of the colouring process, there may be slight colour variation between products and batches. Returning items based on this discrepancy will be classified as a ‘change of mind return’ and, therefore, must be made in accordance with our change of mind policy.

Skeleton Glass reserves the right to withdraw any products from our website at any time and/or remove or edit any materials or content on our website.

Orders

You, the client is taken to have exclusively accepted and is immediately bound, jointly and severally, by these terms and conditions if you place an order for or accepts delivery of the Goods. 

In the event of any inconsistency between the terms and conditions of this Contract and any other prior document or schedule that the parties have entered into, the terms of this Contract shall prevail.

Please be aware that your order or the supply of goods will not be secured until payment is processed and it has been approved. 

 

In the event you apply for a credit line, you acknowledge that the supply of Goods on credit shall not take effect until the Client has completed a credit application with Skeleton Glass and it has been approved with a credit limit established for the account.

In the event that the supply of Goods request exceeds the Clients credit limit and/or the account exceeds the payment terms, the Supplier reserves the right to refuse Delivery.

However, if you are paying by credit card, debit card, or direct deposit, we will not complete your order until your payment has passed our internal validation procedures. Once your payment has been validated, we will process your order and provide you with your order reference number. Please keep your order reference number for future reference.

All orders require payment in full (100%) at either before delivery of goods/services or at the time of installation or delivery/pick up of goods or by way of instalments/progress payments in accordance with Skeleton Glass' payment schedule

In the event that the Goods and/or Services provided by Skeleton Glass are the subject of an insurance claim that the Client has made, then the Client shall be responsible for the payment of any monies payable to the insurance company and agrees to honour their obligation for payment for such transactions invoiced by Skeleton Glass and shall ensure payment is made by the due date irrespective of whether the insurance claim is successful. 

 

In the event that you are arranging or organising the supply of Goods and/or Services on behalf of a third party, then you acknowledge and accept that you shall be responsible for payment of the Goods and/or Services in the event that the third party defaults in all or any part of payment of the Price.

Electronic signatures shall be deemed to be accepted by either party providing that the parties have complied with Section 14 of the Electronic Transactions (Queensland) Act 2001 or any other applicable provisions of that Act or any Regulations referred to in that Act.

Price and Payment

Quoted prices made by a Skeleton Glass sales representative in writing are valid for 30 days from the date of issue.

Where you have not received a valid written quote from a Skeleton Glass representative, the price payable for a product is the one set out according to our current price list at the time you place your order. All prices are inclusive of GST. We make every effort to ensure product information on our website are correct and up-to-date.

 

Skeleton Glass reserves the right to change the price if:

 

  • a variation to the Goods which are to be supplied is requested or

  •  if a variation to the Services originally scheduled (including any applicable plans or specifications) is requested or

  • where additional Services are required due to the discovery of hidden or unidentifiable difficulties (including, but not limited to, poor weather conditions, limitations to accessing the site, availability of machinery, safety considerations, prerequisite work by any third party not being completed, obscured building defects, change of design, additional Services required in order to comply with building standards) which are only discovered on commencement of the Services or

  • in the event of increases to the Supplier in the cost of labour or materials which are beyond the Supplier’s control. 


We accept Cash, Cheque, Bank Cheque, Electronic/on-line banking, Visa, Mastercard, and Amex (a surcharge may apply per transaction)

Your credit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Whilst we employ the latest technology, we will not be responsible for any loss or damage suffered by you (direct or indirect) if your credit card is fraudulently used or is used in an unauthorised manner by a third party. Your tax invoice will be sent to you when the items you have ordered are delivered.

Remember that returns, warranty claims, refunds, or repair requests must be accompanied by any one of the following proof of purchase documents:

  • Receipt tax invoice (order confirmations alone will not be accepted).

  • Financial statements that evidence the transaction, such as a bank statement or credit card statement. Please ensure you retain your proof of purchase.

Delivery of Goods

Delivery of the Goods is taken to occur at the time that:

​

  • You or your nominated carrier takes possession of the Goods at the Skeleton Glass Showroom

  • Skeleton Glass (or Skeleton Glass's nominated carrier) delivers the Goods to your nominated address even if you are not present at the address

​

At the discretion of Skeleton Glass, the cost of delivery is either included or is an addition to the price.

​

Skeleton Glass may deliver the Goods in separate instalments. Each separate instalment shall be invoiced and paid in accordance with the provisions in these Terms and Conditions.

​

Subject to clause, it is Skeleton Glass's responsibility to ensure that the Services start as soon as it is reasonably possible. However in the event that sees the Services commencement date be put back and/or the completion date extended by whatever time is reasonable in the event that Skeleton Glass claims an extension of time (by giving the Client written notice) where completion is delayed by an event beyond the Supplier’s control, including but not limited to any failure by the Client to:

​

  • Make a selection or

  • Have the site ready for the services or

  • Notify Skeleton Glass that the site is ready.

​

Any time specified by Skeleton Glass for delivery of the Goods is an estimate only and Skeleton Glass will not be liable for any loss or damage incurred by the Client as a result of delivery being late. However both parties agree that they shall make every endeavour to enable the Goods to be delivered at the time and place as was arranged between both parties. In the event that Skeleton Glass is unable to supply the Goods as agreed solely due to any action or inaction of the Client, then Skeleton Glass shall be entitled to charge a reasonable fee for redelivery and/or storage.

Risk

Risk of damage to or loss of the Goods passes to the Client on Delivery and the Client must insure the Goods on or before Delivery.

If any of the Goods are damaged or destroyed following delivery but prior to ownership passing to the Client, Skeleton Glass is entitled to receive all insurance proceeds payable for the Goods. The production of these Terms and Conditions by Skeleton Glass is sufficient evidence of Skeleton Glass's rights to receive the insurance proceeds without the need for any person dealing with Skeleton Glass to make further enquiries.

If you request Skeleton Glass to leave Goods outside your premises for collection or to deliver the Goods to an unattended location, then such Goods shall be left at your sole risk. 

​

Skeleton Glass shall be entitled to rely on the accuracy of any plans, specifications and other information provided by you. You acknowledge and agree that in the event that any of this information provided by you is inaccurate, Skeleton Glass accepts no responsibility for any loss, damages, or costs however resulting from these inaccurate plans, specifications or other information.

Where Skeleton Glass is required to install the Goods, you warrant that the structure of the premises or equipment in or upon which these Goods are to be installed or erected is sound and will sustain the installation and work incidental thereto and Skeleton Glass shall not be liable for any claims, demands, losses, damages, costs and expenses howsoever caused or arising in connection with the installation and work incidental thereto.

You acknowledge that Skeleton Glass is only responsible for parts that are replaced by Skeleton Glass and that in the event that other parts/Goods, subsequently fail, you agree to indemnify Skeleton Glass against any loss or damage to the Goods, or caused by the Goods, or any part thereof howsoever arising. 

​

Whilst every care shall be taken by Skeleton Glass, any damage or breakage to your existing glass during the provision of the Services by Skeleton Glass shall be at your own risk. 

​

Holes, cut outs and cutting of the Goods may weaken the strength of the Goods and although it’s unlikely, cracking may occur. Skeleton Glass accepts no responsibility against cracks occurring after such Goods (that are subject to holes and cut outs) are installed unless a toughened glass is used. 

You acknowledge and agree that Skeleton Glass shall not accept the return, nor give any refund on any glass that has already been cut as it cannot be resold. 

 

You acknowledge that Goods supplied may:

 

  • exhibit variations in shade, colour, texture, surface, finish, markings and may contain natural fissures, occlusions, lines, indentations and may fade or change colour over time; and 

  • expand, contract or distort as a result of exposure to heat, cold, weather; and 

  • mark or stain if exposed to certain substances; and 

  • be damaged or disfigured by impact or scratching.

Any advice, recommendation, information, assistance or service provided by Skeleton Glass in relation to Goods or Services supplied is given in good faith, is based on Skeleton Glass's own knowledge and experience and shall be accepted without liability on the part of Skeleton Glass and it shall be the responsibility of you to confirm the accuracy and reliability of the same in light of the use to which you make or intend to make of the Goods or Services.

Access

You shall ensure that Skeleton Glass has clear and free access to the work site at all times to enable them to undertake the Services. Skeleton Glass shall not be liable for any loss or damage to the site (including, without limitation, damage to pathways, driveways and concreted or paved or grassed areas) unless due to the negligence of Skeleton Glass. 

Mirror Edgecreep

There is no warranty on mirror edgecreep, however Skeleton Glass upon installation will use every preventative precaution including ensuring the edges are dry when installed and mirror edges are properly sealed with professional grade neutral cure silicone or no gaps that are made to help deter moisture, abrasive cleaners, salt air and humidity forming behind the mirror. We strongly encourage all our customers (DIY & Wholesale) who we supply to, to properly seal all edges with the correct product as it is the best preventative measure against edgecreep. It is also important to note that using any acidic silicones will react with the mirror and cause edgecreep so it is important to use the correct product when sealing.

Colour & Image Disclaimer

The information provided on this website and in our catalogue is for general information purposes and use only. Every endeavour is made to keep the product information complete and correct. Despite every effort to provide accurate images of each product’s colour and design, actual colours and design may vary slightly, due to different device screen settings, the lighting in the installation location, slight differences in product finishes over time and other factors.

Skeleton Glass will not accept responsibility for any colour or design differences that are not factory faults. In purchasing from Skeleton Glass, you agree to accept the small risk that there will be a slight variation between the actual colour and design, and the representation on our website. In addition, please be aware that colours and textured finishes often vary between manufacturers. Also specific products can be subject to availability.

The customer is responsible in obtaining a physical sample and for ensuring the colour & product is correct and suitable for their specific requirements before they place an order.

Compliance
with Laws

You and Skeleton Glass shall comply with the provisions of all statutes, regulations and bylaws of government, local and other public authorities that may be applicable to the Services. 

 

You shall obtain (at your own expense) all licenses and approvals that may be required for the Services. 

​

You agree that the site will comply with any relevant work health and safety laws and any other relevant safety standards or legislation. 

Cancellations

Without prejudice to any other remedies Skeleton Glass may have, if at any time you are in breach of any obligation (including those relating to payment) under these terms and conditions, Skeleton Glass may suspend or terminate the supply of Goods to you. Skeleton Glass will not be liable to you for any loss or damage you suffer because Skeleton Glass has exercised its rights under this clause.

Skeleton Glass may cancel any contract to which these terms and conditions apply or cancel delivery of Goods at any time before the Goods are delivered by giving written notice to you. On giving such notice Skeleton Glass shall repay you any money paid by you for the Goods. Skeleton Glass shall not be liable for any loss or damage whatsoever arising from such cancellation.

In the event that you cancel delivery of Goods, you shall be liable for any and all loss incurred (whether direct or indirect) by Skeleton Glass as a direct result of the cancellation (including, but not limited to, any loss of profits). 

​

Cancellation of orders for Goods made to your specifications, or for non-stocklist items, will definitely not be accepted once production has commenced, or an order has been placed. 

General

We may change any provision in these terms and conditions without notice. Therefore we advise that, even if you are a frequent purchaser from us, you check these terms and conditions whenever you want to purchase products from us. Any change of these terms and conditions will only apply to future orders. None of our agents, employees or third parties has the authority to change these terms and conditions.

We reserve the right to refuse supply of the products or services ordered by you, terminate our contract with you, or terminate your account with us, and to remove or edit content on our website at our sole discretion and without incurring any liability to you.

You must not assign any rights and obligations under these terms and conditions, whether in whole or in part, without our prior written consent.

If any provision of these terms and conditions is invalid, illegal or unenforceable, these terms and conditions take effect (where possible) as if they did not include that provision.

Any failure by a party to insist upon strict performance by the other of any provision in these terms and conditions will not be taken to be a waiver of any existing or future rights in relation to the provision.
